Traffic Accidents Outside of Kosova
Before You Travel
-
Check Your Documents and Equipment: Make sure you have your personal documents (passport, driver's license, vehicle registration) and that your vehicle is in good technical condition.
-
Green Card: Even if not required in some countries due to international agreements, it's recommended to have a Green Card. It serves as proof of international insurance and may be necessary in case of an accident.
-
European Accident Statement: Take this form with you. It's a standardized document that helps you accurately record the details of an accident and avoid misunderstandings.
At the Accident Scene – What to Do
-
Notify local law enforcement (e.g., the police) when necessary, especially in case of conflict, disagreement, or injuries.
-
Gather the necessary information:
-
License plate and details of the other driver (name, address), their insurance company, and policy number.
-
Photos of the other driver's Green Card if the vehicle has foreign plates.
-
Information from witnesses and photos of the accident scene.
-
-
Fill out the European Accident Statement. This is not an admission of guilt, but a tool to document the objective facts.
After the Accident – Seeking Compensation
When the Other Driver is at Fault:
-
Seek compensation from the at-fault driver's insurer:
-
In the country where the accident occurred, ask for a guarantee that the amount will be paid directly to the repair shop if you decide to fix the vehicle there.
-
In some countries, an authorized representative of the foreign insurer can accept the claim on behalf of the insurer.
-
If there is no such representative, the Kosovo Insurance Bureau (BKS) can act as an intermediary based on systems similar to the Green Card and other international agreements.
-
When You are at Fault:
-
Provide a copy of your Green Card as proof that you have insurance, especially when requested by authorities or the other party.
-
Immediately notify the BKS of the situation. This is important for a quick start to the compensation process.
The Laws of the Country Where the Accident Occurs Determine the Procedures
-
Carefully apply local rules: The laws and deadlines of the country where the accident occurred are the ones that apply to compensation claims.
